The Demise of the 28-Clause Ceasefire Plan for Ukraine: Why Diplomatic Efforts Continue to Falter

Europe breathed a deep collective sigh of relief on Monday, as the crisis sparked by the presentation of a new 28-article proposal for achieving ceasefire appeared – briefly – to have been contained. A American diplomat spoke of "substantial progress" after Ukraine-US talks in Geneva. On Monday night, Russian leadership made its retaliation: another massive barrage of missile and drone strikes on Kyiv.

The Cycle of Peace Talks and Military Action

The succession of conflicting incidents captured the harsh reality of the recent timeframe. By day, diplomatic battles are conducted: hopeful statements are delivered from different nations. Significant resources is allocated on containing particular approaches. By night, the Kremlin forcefully demonstrates the world that, for them, conflict continues to be the key method for achieving "peace".

Nocturnal Warfare

As Russia's attack developed into the early hours of Tuesday, the current condition of Ukraine's defenselessness was revealed. Ukraine is equipped to monitor projectile deployments from across the border, a capability provided through current data. From observation points, defense planes that had been deployed to counter approaching guided weapons flew past – sophisticated military planes provided to Ukraine by Western partners.

Moments later, Kyiv's anti-aircraft weapons activated: several firings deployed against a Russian ballistic missile. This was a sophisticated defense system at work, probably delivered by Western nations. Every launch creates sudden vibrations, shaking the windows. The brief panic quickly becomes grim resignation: perhaps the incoming missile won't hit its mark this time, preventing destruction from catastrophe and additional electricity failures.

Ongoing Risks

Following this, a heavy machine gun opened up on a aerial vehicle close by, part of a defensive team – most likely allied-provided weaponry. Regrettably, the projectiles didn't strike the opposing UAV – it maintained course toward its destination.

Intermittently, this carried on until dawn. Kyiv faced the morning news: seven people killed, destruction and infrastructure problems in many homes as a result of the evening attack. As always, everyone still went about their day – enduring hostilities. But those entire period illustrated Ukraine's critical military reliance on external assistance – a dependence that European nations are evidently unprepared to fill in the near term.

Failed Diplomacy

The detailed framework from American leadership generated strong feelings, debate and profound anxiety – and briefly redirected concern from Ukraine's major integrity crisis in years. Yet, we have seen this script before, after previous diplomatic encounters and international summits.

Every new approach from US leadership adheres to the same pattern: a political offensive against Ukraine, which Kyiv, with other European capitals, succeeds in resisting. They manage the tension but never actually secure success. This cycle will, no doubt, continue.

Tactical Assessments

It is easy to blame particular leaders of repeatedly advocating Russian terms. But that does not seem to be the whole story. American leadership operates on a premise understood by international relations experts: you cannot win at the negotiating table what you have been unable to protect through force. The American government believes that it is unfeasible to compel Moscow to surrender the territory that it presently holds in Ukraine's occupied territories.

The problem is that while accepting these circumstances, US leadership does minimal to prevent Kremlin actions, through diplomacy or military means, from believing that the status quo will not shift further in its favour in the near future.

Divergent Views

Therefore, the Kremlin is confident that time is on his side – that Ukraine and its allies are nearing depletion. Their incentive to sign a deal that does not give them the largest achievable advantage is almost completely absent. There may be numerous efforts to stop fighting, but they will carry on as long as Russia's leader remains highly assured in the outcome.

On the contrary, Ukrainian leadership believes that Ukraine can still persist, progressively conceding lives and land but avoiding a total frontline collapse until situations evolve in its favour.

Present Conditions

Objectively, there are no real preconditions for a truce. Now, subjective factors are becoming relevant: leadership ambitions to mediate resolution and achieve global acclaim, and Kyiv's twin challenges – on one hand, not to estrange crucial supporters, and on the other, to rally Ukrainians around the flag against any proposal Kyiv finds unacceptable, so that their priority does not move to homefront challenges. And although their objective will now be much harder after recent developments, it remains quite doubtful that this will change their overall approach.

These conflicting dynamics are guiding negotiations.

Conclusion and Outlook

It took a only one week to eliminate the suggested clauses of the current initiative. Assertive and inconsistent approach of the matter by American leadership, resistance by Ukraine and the remaining European nations, along with soothing efforts of representatives, and finally, current information leaks, all served their function.

While new proposals based on previous concepts are approaching, Kyiv, London and other European capitals should arrive at a critical understanding: Ukraine and Europe will only be able to resist negotiation assaults from Washington that are founded on Moscow's terms and show specific hesitation to modify developments, if they stand together and improve their protective measures at a much faster pace. If they do, no combination of diplomatic or military actions will be able to break them. In the meantime, Ukraine's capacity to counter nocturnal attacks will, for the foreseeable future, primarily depend on sustained allied backing.
